Terms of Conditions
1. By completing this form and USPS Form 1583, which will be made available to the United States Postal Service, the Applicant appoints Mailbox Service as an agent for receiving mail and packages through common carriers for a period not to exceed that rent has been paid in advance.
2. The Applicant agrees not to use the Mailbox Service premises or any services for any unlawful, illegitimate, fraudulent purpose or purpose prohibited by U.S. postal regulations. The Applicant further agrees that any Mailbox usage shall conform with all applicable federal, state, and local laws.
3. This Agreement and Form 1583 shall remain confidential, except that this Agreement and Form 1583, including Applicant's name, address, and email address, and other personal information provided by Applicant will not knowingly be disclosed without Applicant's consent, except for law enforcement or postal operation purposes, wherein Mailbox Service intends to cooperate fully. Law enforcement is further clarified to include all city, county, state, or federal agencies or their representatives.
4. Mailbox Service fees are due and payable in advance, whether notice is placed in Applicant's Mailbox or not. Applicant agrees that failure to pay such fees when due may result in disruption or cancellation of services. Mailbox Service does not prorate fees or provide refunds in the event of cancellation by Applicant or Mailbox Service.
5. Applicant will pick up mail and other shipments at least once each week or make other suitable arrangements in advance with Mailbox Service. Mailbox Service will provide a mailbox key to the Applicant, who may obtain their mail during the business hours posted by Mailbox Service. Should the Applicant appoint another person or organization to collect mail or other shipments, Mailbox Service shall assume that possessing a key is evidence of authority to collect mail or other shipments.
6. The key loaned to Applicant may require a refundable cash deposit, and this key remains the property of Mailbox Service and shall not be duplicated or modified by Applicant. Any key deposit fee shall be refunded upon return of the key within ten (10) days of termination of service. Applicant understands that the parties' relationship hereto is one of bailment, not landlord and tenant.
7. Once Mail Service has placed Applicant's mail or other shipments in the assigned Mailbox, the mail shall be deemed delivered, and Mailbox Service shall not be responsible for loss, theft, or damage. Notices for packages too large for the Mailbox will not be placed in the Mailbox but stored by Mailbox Service and will require a signature from the Applicant on pickup. Mailbox Service is not engaged in delivering mail or other carrier shipments. It cannot be responsible for the failure of the United States Postal Service or other carriers to deliver parcels or deliver them in a timely or undamaged condition.
8. Applicant agrees to use facilities and services in accordance with Mailbox Service rules and compliance with U.S. Postal regulations and local, state, and federal statutes and regulations. Failure to do so may result in service cancellation without notices, refunds, or mail forwarding.
9. Upon request, Applicant agrees to complete all necessary documents, including Form 1583 and any required acknowledgment form relating to the service of process. The Applicant further agrees to sign a revised version of this Agreement and Form 1583 whenever any information needed on this Agreement or Form 1583 changes.
10. Mail and other shipments will not be accepted for more than three (3) persons or organizations in a single mailbox without the written approval of Mailbox Service, and each mail name must complete a USPS From 1583 and must provide approved identification and sign a mailbox contract and state forms if in a state that requires such. Additional fees may apply for each business name receiving mail.
11. If the Applicant consistently receives substantially more mail and other shipments than can be placed in a single mailbox, Mailbox Service reserves the right to require the Applicant to rent a larger box or one or more additional boxes. Service charges are based on average daily volume and activity. Exceptional circumstances, e.g., a high number of parcels, etc., may require assessment of additional fees. An unusually high volume of mail will result in a higher fee or termination of the mail-receiving service.
12. Applicant further agrees that parcels delivered to this address for the Applicant will be delivered by common carrier only, that no truck line deliveries will be made, that packages too large for Mailbox will be retrieved within 24 hours after delivery and that no hazardous material will be delivered to Applicant. Failure to adhere to any of these parcel delivery stipulations will result in additional fees and/or termination of service.
14. Should Mailbox Service commit or fail to commit an act that disrupts service and Applicant consequently suffers a loss, Mailbox Service's liability shall be limited to not more than the rental fees paid by Applicant for service not yet received. Mailbox Service shall not be liable for incidental or consequential damages.
15. Per USPS regulations, accountable mail, including but not limited to certified, insured, or C.O.D. mail or parcels, shall be accepted by Mailbox Service on the Applicant's behalf. Full advance payment of C.O.D. charges must be made to Mailbox Service before acceptance of C.O.D. packages. Restricted delivery mail may be accepted with prior written permission on the Applicant's USPS Form 1583, block 5.
16. The Applicant is responsible for notifying correspondents of the correct address. The address to be used by Applicant to receive mail must conform to Postal Regulation. (DMM 1.8.2 e-g). The Applicant shall use only the address designation P.M.B; or #; to designate their address. (P.M.B. means Private Mail Box) NO OTHER DESIGNATION IS VALID. Expressly excluded is the use of suite, apt., dept., or other designators for the Applicant's Mailbox. The U.S. Postal Service may refuse to deliver mail that does not include the P.M.B. or # sign designation.
17. Upon termination of services by Mailbox Service or failure to pay rent in advance by Applicant, Mailbox Service shall not make Applicant's mail available without payment. Applicant understands that the United States Postal Service will not forward or return mail without payment and will not accept a Change of Address.
18. At the termination of service, the Applicant is responsible for making arrangements with the Center to identify any mail forwarding needs before the Agreement expires, cancels, or terminates. If the Applicant wishes mail to be forwarded after that date, the Applicant shall provide Mailbox Service with a forwarding address and pay the required fees. If Applicant fails to do this, Mailbox Service will & Return to Sender all mail received.
19. Applicant agrees to be responsible for forwarding all mail at the termination of this Agreement. Applicant understands that the US Postal Service will NOT forward or return mail without payment and will not accept a Change of Address; from a private mail center address (businesses such as Mailbox Service). This constitutes a Do Not Forward agreement as per D.M.M. 508.1.8.3.b.
20. In the event of death or incapacity of the Applicant, the Center will require the appropriate documents from a representative with a notarized power of attorney, the Probate Court, the executor of the estate the trustee, or other similar person or entity before releasing mail or packages to a requesting party.
Privacy Act Statement:
Your information will be used to authorize your mail delivery to the designated addressee as your Agent. Collection is authorized by 39 USC 401, 403, and 404.
Providing the information is voluntary, but if not provided, we cannot offer this service to you. We do not disclose your information without your consent to third parties, except for the following limited circumstances: to a congressional office on your behalf; to financial entities regarding financial
transaction issues; to a USPS auditor; to entities, including law enforcement, as required by law or in legal proceedings; to contractors and other entities aiding us to fulfill the service; and to identify an address as an address of an agent who receives mail on behalf of other persons. Information
